Welcome to Zack ("we", "us", or "our"). These Terms and Conditions (“Terms”) govern your use of our task management application, website, and any related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, please do not use the Service.

 

1. Definitions
 

Service: The Zack mobile application, web platform, and all related services.
User Content: Any data, information, text, files, or attachments submitted by users via the Service.
Subscription: A paid plan or tier that provides access to additional or premium features.
Account: A registered user profile that provides access to the Service.
You / User: Any individual or entity using our Service.

 

2. Acceptance of Terms

By using Zack, you agree to comply with these Terms and our Privacy Policy.

 

3. Eligibility


​

You must be at least 16 years old to use the Service. By registering, you confirm that you are of legal age and capable of entering into a legally binding agreement under applicable law. If the laws of your country require a higher minimum age for you to legally use the Service without parental consent, the higher age applies.

4. Account Registration

To access certain features, you must register for an Account. You agree to:
• Provide accurate and complete information,
• Keep your login credentials secure,
• Notify us immediately of any unauthorized access.
We are not liable for any loss or damage arising from unauthorized access to your account.

5. Use of the Service

You agree to use the Service only for lawful purposes. You must not:
• Use the Service to transmit harmful code or malware,
• Attempt to gain unauthorized access to the Service or other accounts,
• Interfere with or disrupt the operation of the Service,
• Use automated systems to scrape or misuse our content.
We reserve the right to suspend or terminate your access for any misuse.

 

6. Acceptable Use Policy

You are prohibited from using the Service to:
• Violate laws or regulations,
• Infringe upon third-party rights, including intellectual property,
• Harass, threaten, or harm other users,
• Upload or distribute illegal, harmful, or offensive material,
• Attempt to reverse-engineer or decompile any part of the Service.
Violations may result in immediate suspension or termination of your Account.

 

7. User Content

You retain all rights to your User Content. By submitting content, you grant us a limited, non-exclusive, revocable, and royalty-free license to use, process, and store it solely for the operation, maintenance, and improvement of the Service. You grant us the permission to process your User Content as needed to provide, maintain, secure, and improve the Service. This includes storage, backup, indexing, and processing by third-party providers strictly for the operation of the Service.

We may generate aggregated and anonymized statistical insights derived from the use of the Service. These insights do not contain personal data, do not identify any user, and cannot be linked back to individual accounts. We may use, publish, or commercialize such aggregated insights for analytics, research, market intelligence, or other lawful business purposes.

 

8. Data Retention and Backups

We take reasonable steps to store and protect your data. However, we do not guarantee recovery of deleted content. You are responsible for maintaining backup copies of your critical information.

We implement reasonable technical and organizational measures to protect your data, but no system can be guaranteed to be fully secure.

 

9. Third-Party Services
 

Our Service may integrate with third-party platforms such as calendar apps, cloud storage, AI assistants or other. Use of those integrations is subject to the third-party’s terms and privacy policies. We are not responsible for the performance or data practices of these external services.

We are not responsible for interruptions, errors, data loss, or security issues caused by third-party providers. Your use of third-party integrations is at your own risk.

10. Pricing and Paid Features

a.  Freemium Model
We offer a Free Plan with access to core task management features and a limited monthly quota of AI-supported tasks.
 
b. Paid Plans
If you exceed the included AI usage or want access to premium features, you may purchase a paid subscription (e.g., Kickstart, Everyday, Always-on, other).
 
c.  Add-Ons
Optional add-ons (e.g., additional AI task credits, insights, or speed boosts) may be purchased separately.
 
d. Usage Limits

Each plan includes a specified number of AI-supported task interactions per month. A fair use policy may apply to Unlimited plans.

Fair use means usage that aligns with normal individual activity levels. Excessive automated requests, disproportionately high daily task generation, or activity that negatively affects system stability may be considered misuse. We may restrict access to ensure performance for all users.

e. Subscription Terms
Paid plans are billed on are recurring basis. You may cancel via your account settings. We may modify pricing or plan structure with prior notice.

11. Subscription and Payments

​

Some features may require a paid Subscription. You agree to pay all applicable fees for any paid plan or add-on you purchase. By subscribing:

• You authorize recurring billing via your selected payment method,

• Fees are non-refundable unless otherwise stated or required by law,

• We may change pricing with prior notice; continued use after changes implies acceptance.

Billing is handled through third-party processors. You are responsible for maintaining valid payment details.

You may cancel at any time via your account settings. Access to premium features will continue until the end of the billing cycle.

If you reside in the European Union, you may have a statutory withdrawal right of 14 days for digital subscriptions. By starting to use paid features during the withdrawal period, you acknowledge that the service is provided immediately and that the withdrawal right may no longer apply once full access is granted.

 

12. Changes to Plans and Pricing

We may revise the features, limits, or pricing of any plan or add-on. We will notify you in advance of any material change that affects your current subscription or usage rights. Continued use of the Service after such changes become effective constitutes your acceptance.

 

13. AI Usage and Limitations
 

The Service includes features powered by third-party AI models. These interactions consume your monthly AI task quota. You acknowledge and agree that:
- The availability and accuracy of AI features depend on external providers
- We may track AI usage for billing and performance monitoring
- We may modify or limit AI access at any time to ensure fair use
- We make no guarantee of specific outcomes or results from AI features

AI-supported features may send content you provide to third-party AI processors for the sole purpose of generating the requested output. Such content is not stored longer than necessary to process the request. AI outputs may contain errors or inaccuracies; you are responsible for reviewing any AI-generated information before using it.

14. Support and Availability

We aim to provide high availability but do not guarantee uninterrupted access. Support is available via email (support@zackapp.space), and response times may vary.
Planned maintenance or outages may be communicated in advance when possible.

 

15. Intellectual Property
 

All rights, title, and interest in the Service, including content, software, and design (excluding User Content), belong to us or our licensors. You may not use our branding, trademarks, or content without our express permission.

You may not copy, reproduce, or imitate any part of the Service, including its design, workflows, interface, or feature structure, for the purpose of creating competing products.

 

16. Termination
 

We may suspend or terminate your access:

• If you violate these Terms,

• If required by law,

• For suspected misuse or fraudulent activity.

You may delete your account at any time. Upon termination, your right to use the Service ends immediately. We may retain your data for legal or operational reasons.

After you delete your account, we will delete or anonymize your personal data within a reasonable period unless we are legally required to retain certain information. You may request erasure of your data in accordance with applicable data protection laws.

 

17. Force Majeure
 

We are not responsible for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, internet outages, cyberattacks, war, or government restrictions.

This includes failures or interruptions of cloud infrastructure or hosting providers that are outside our reasonable control.

 

18. Disclaimer of Warranties

The Service is provided “as is” and “as available” without any warranties, express or implied. We do not guarantee that the Service will meet your expectations or be error-free, secure, or uninterrupted.

19. Limitation of Liability
 

To the maximum extent permitted by law, we are not liable for:

• Indirect, incidental, special, or consequential damages,

• Loss of data, profits, or business opportunities,

• Any claim arising from your use or inability to use the Service.

The Service, including AI-generated content, is not intended for use in safety-critical, medical, financial, or legal decision-making. We are not liable for any decisions or actions taken based on AI-generated outputs.

Total liability is limited to the amount paid by you (if any) for the Service in the past 12 months.

You use Zack at your own risk.

 

20. Dispute Resolution

You agree to attempt informal resolution of any dispute by contacting us first. If unresolved, disputes shall be settled through binding arbitration under the laws of Zurich, Switzerland, unless prohibited by applicable law.
 

21. Changes to These Terms
 

We may revise these Terms from time to time. If changes are material, we will notify you via email or in-app messages. Continued use of the Service after changes become effective constitutes acceptance.

If you do not agree to the updated Terms, you must discontinue using the Service. Notices may be provided via email, in-app messages, or announcements within the Service.

 

22. Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles. Jurisdiction for legal disputes lies in Switzerland/Zurich.
